Standard working hours: 40 hours per week and 1,800 per year
Standard working hours in Andorra are 40 hours per week, and on an annual basis the maximum duration is 1,800 hours, under Law 31/2018 on labour relations.
Reduced hours may be agreed by contract, and there is a special working time arrangement with quarterly, half-yearly or annual calculation: it is planned one month in advance, any change is notified with seven days' notice and it is monitored through a personal hours account that the worker receives each month with their payslip.
Overtime: legal limits
Overtime is any time exceeding the maximum duration of the legal or agreed standard working hours. The law allows it to be agreed up to a maximum of 12 hours per week, 48 per month and 426 per year, one of the highest caps in Europe.
That volume is not unrestricted: it is only justified by a lack of staff to cover shifts, a temporary increase in activity due to market conditions, or extraordinary or force majeure circumstances.
The initiative lies with the company, and the employee may freely accept or refuse it except in cases of force majeure. Overtime work is prohibited for under-18s and pregnant women, and any agreement waiving the right to refuse it is void.
How overtime and night work are paid
Each overtime hour entitles the worker to an increase on the base salary set by agreement or collective bargaining agreement. If there is no agreement regulating it, the surcharge cannot be less than 40% of the fixed salary.
The company may compensate overtime with rest time instead of money, always with the worker's prior agreement, with the same increases and within the following six months.
Night work (between 22:00 and 06:00) is paid with a minimum increase of 20% on the ordinary salary, unless the salary has already been agreed taking that circumstance into account.
Daily and weekly rest
On working days of six or more uninterrupted hours, the worker is entitled to a paid rest break of at least 30 minutes. If the working day is interrupted, the break must be at least one unpaid hour.
There must be a minimum rest of 12 hours between two standard working days, and weekly rest is one full day, mandatory and non-waivable. It can only be modified by agreement, by force majeure with 24 hours' notice, or for organisational reasons with 30 days' notice and a maximum of two changes per year.
Holidays and public holidays
Paid holiday is a minimum of 30 calendar days per year, or 22 working days if agreed. It is mandatory, cannot be waived, and the period is set by agreement or collective agreement, with 45 days' notice.
It may be split, but always leaving at least 14 consecutive calendar days (or 10 working days if the 22 days were agreed). The maximum that can be accumulated never exceeds 30 calendar days.
In addition, the worker is entitled to the public holidays in the Andorran working calendar, paid, with parish holidays depending on the parish where the company is located.
